Terms and Conditions of Use

1. Introductory Provisions

These Terms and Conditions of Use (hereinafter referred to as the "Terms") govern the legal relationship between S.C. F&B GLOBAL SOLUTION S.R.L., headquartered in Romania, Bucharest, Sector 6, Iuliu Maniu Blvd, Building 1, Office 2.11, Compartment 16, 2nd Floor, registered at the Trade Registry under no. J2024019834007/04.09.2024, with unique registration code 50502313 (hereinafter referred to as the "Operator" or "Provider"), and any individual or legal entity accessing and/or using the website fb-global-solutions.ro (hereinafter the "User").

Accessing, browsing, or otherwise using the platform implies full, express, and unconditional acceptance of these Terms. If you do not agree with these Terms, you must immediately cease using the platform and its services.

2. Object of the Platform

The fb-global-solutions.ro platform primarily offers:

  • E-commerce services internationally, consisting of the sale of equipment, tools, and accessories for the Food & Beverage sector;
  • Design, manufacturing, and delivery services of Food & Beverage Express Trucks, custom-made and delivered internationally based on individual orders;
  • Entertainment, event organization, and equipment rental services for private events, offered exclusively in Romania through the "Entertainment T.E.A.M." division.

3. User Eligibility

The platform is intended solely for individuals who have reached the age of 18. By accepting these Terms, the User declares that:

  • They have full legal capacity;
  • They provide accurate, complete, and up-to-date information;
  • They will not use the platform for fraudulent or unlawful purposes.

The Operator reserves the right to suspend or terminate access to the account of any User who provides false information or violates these Terms.

4. Account Creation and User Obligations

4.1. Certain platform functionalities (e.g., placing orders, accessing personalized offers) require the creation of a User account.

4.2. The User is fully responsible for maintaining the confidentiality of their login credentials and for all activities performed through their account.

4.3. The User is obligated to keep their personal data updated and to use the platform in compliance with the law and good practices.

5. Products, Orders, and Commercial Terms

5.1. Product Description

All products displayed on the site are presented for informational purposes only. Images are illustrative. For customized equipment (trucks), technical specifications will be expressly confirmed contractually.

5.2. Order Placement

Orders are placed electronically via the platform and are considered binding only after:

  • Confirmation via email by the Operator;
  • Full payment or advance payment (if applicable).

5.3. Prices and Billing

All prices shown are in EUR, include VAT where applicable, and may be updated unilaterally by the Operator without prior notice.

Payments are made through authorized payment processors (Stripe). Invoices are issued electronically.

5.4. Delivery and Deadlines

  • Standard equipment will be delivered internationally by authorized couriers within the estimated timeframe provided at order placement;
  • Food & Beverage Trucks orders are delivered according to the individual contract, with expressly agreed and staged deadlines.

The Operator shall not be liable for delays caused by third parties (couriers, customs, manufacturers, etc.).

6. Withdrawal and Returns

6.1. Standard Products

According to applicable legislation (Government Emergency Ordinance 34/2014), the User has the right to return standard products, without penalties and without giving any reason, within 14 calendar days from receipt.

Returns are made at the User's expense, in original packaging, unused, with all accessories.

6.2. Customized Products

Made-to-order products, including Food & Beverage Express Trucks, are non-returnable, pursuant to Article 16(c) of GEO 34/2014.

7. Warranties and Limitation of Liability

7.1. The Operator provides commercial warranty only for products eligible under specific terms.

7.2. The platform is provided "as is". The Operator does not guarantee uninterrupted or error-free operation of the platform.

7.3. The User understands and accepts that use of the platform is at their own risk and that the Operator is not liable for:

  • Direct or indirect losses caused by use of the site;
  • Delivery delays caused by third parties;
  • Improper use of delivered products.

8. Intellectual Property

All content on the platform, including but not limited to text, images, logos, source code, graphic design, is the exclusive property of the Operator and protected under Romanian and international copyright laws.

Use, reproduction, modification, or distribution without express written consent is prohibited.

9. Personal Data and Cookies

9.1. Personal data is processed in accordance with EU Regulation 2016/679 (GDPR) for European Union users and California Consumer Privacy Act (CCPA) for United States users.

10. Account Suspension and Termination

The Operator reserves the right to suspend or terminate a User's account without prior notice in cases of:

  • Non-compliance with these Terms;
  • Justified suspicion of fraud;
  • Abusive or illegal use of the platform.

11. Force Majeure

Neither party shall be held liable for failure to perform obligations caused by force majeure events as defined by law. Force majeure suspends obligations until the event ceases.

12. Dispute Resolution

12.1. The parties shall attempt amicable settlement of any dispute.

12.2. Failing amicable resolution, jurisdiction lies with the courts of the Operator's registered office (Romania), applying Romanian law, except where mandatory laws of the User's jurisdiction prevail.

13. Governing Law

The contractual relations are governed by Romanian law. For users outside Romania, applicable mandatory consumer protection laws of their jurisdiction shall apply.

14. Amendments to the Terms

The Operator reserves the right to unilaterally amend these Terms. Amendments take effect upon publication on the site and are binding from that date onward.
