This Cookie Policy (hereinafter referred to as the "Policy") is issued by S.C. F&B GLOBAL SOLUTION S.R.L., having its registered office in Romania, Bucharest, Sector 6, B-dul Iuliu Maniu, Corp 1, Office 2.11, Compartment 16, Floor 2, registered with the Trade Register under no. J2024019834007/04.09.2024, having tax identification code 50502313 (hereinafter referred to as the "Controller"), as the administrator of the fb-global-solutions.ro platform (the "Platform"), and aims to inform users in a clear, comprehensive, and transparent manner about the mechanisms used to collect data automatically through cookies and similar technologies, in compliance with applicable national and international data protection legislation, including but not limited to Regulation (EU) 2016/679 ("GDPR") and the California Consumer Privacy Act ("CCPA").

1. Purpose and Scope

This Policy sets out the rules governing the use of cookies and related technologies on the Platform, including the types of cookies used, the legal bases for their use, the rights of data subjects, and how those rights may be exercised.

This Policy applies to all users accessing the Platform, regardless of their jurisdiction of residence, and supplements the Privacy Policy, which governs the general data processing activities carried out by the Controller.

For the purposes of this Policy, the following terms shall have the meanings assigned below:

Cookie - a small data file composed of letters and numbers, generated by a server and stored on the user's terminal (computer, mobile phone, tablet, etc.), which facilitates navigation, stores user preferences, and/or allows analysis of traffic or personalized content delivery.

Controller - S.C. F&B GLOBAL SOLUTION S.R.L., in its capacity as the entity determining the purposes and means of processing personal data via cookies used on the Platform.

User - any natural person who accesses, visits, or uses the Platform, with or without an account.

The Platform may use the following categories of cookies:

a) Strictly Necessary Cookies

These are essential for the proper functioning of the Platform, including user authentication, session management, and traffic security. These cookies cannot be disabled in our systems.

b) Analytical Cookies

These collect aggregated, anonymized data about how users interact with the Platform, to help us optimize its structure, content, and performance.

c) Marketing and Profiling Cookies

These are used to personalize advertising content, track conversions, and analyze user behavior for advertising purposes.

4. Legal Basis for Processing

For users located within the European Union:

  • Strictly necessary cookies are used based on the Controller's legitimate interest (Article 6(1)(f) of the GDPR).
  • Analytical and marketing cookies are implemented only based on the explicit, informed, and freely given consent of the user, in accordance with Article 6(1)(a) of the GDPR.

  • In accordance with the CCPA, users have the right to be informed about the collection and sharing of data via cookies, to opt out of the sale or sharing of such data ("Do Not Sell or Share My Personal Information"), and to request deletion of collected data.
  • The Controller declares that it does not sell personal data collected via cookies and does not obtain direct or indirect financial benefits from such activity.

5. Managing Consent

Users may manage their cookie preferences using the following mechanisms:

  • On first access to the Platform, consent is requested through a visual banner that allows acceptance or rejection of analytical and marketing cookies.
  • Withdrawal of consent may be exercised at any time by:
    • Accessing the "Cookie Management" section (available in the Platform footer);
    • Modifying the settings of the web browser;

6. Third-Party Cookies

  • DigitalOcean LLC - for hosting and infrastructure services.

Where necessary, the Controller has concluded Data Processing Agreements (DPAs) with these providers and has verified their compliance with applicable data protection legislation.

7. User Rights

Depending on the applicable legislation, users may exercise the following rights with respect to data collected via cookies:

  • The right to access the collected data;
  • The right to be informed clearly and completely about the purposes, legal bases, and recipients of processing;
  • The right to withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal;
  • The right to request deletion of personal data;
  • The right to restrict or limit processing;
  • The right not to be subject to automated decision-making (including profiling) with legal effects;
  • The right to lodge a complaint with the competent supervisory authority (e.g., ANSPDCP in Romania or the appropriate authority in the U.S.).

8. Retention Period

The lifespan of cookies varies depending on their type:

  • Session cookies are deleted automatically upon closing the browser.
  • Persistent cookies may remain stored for up to 24 months, depending on the third-party provider or the settings configured by the Controller.

9. Revisions and Amendments

The Controller reserves the right to amend this Policy at any time, where necessary, due to changes in legislation, jurisprudence, technical factors, or operational needs.

The date of the most recent update is displayed at the top of this document. Amendments become effective upon publication on the Platform and shall apply to all users as of that date.
